Terms of Service

These Terms and Conditions govern each dog adoption facilitated by Donate 4 Dogs. By submitting an adoption application, paying an adoption fee, taking possession of a dog, or otherwise proceeding with an adoption through Donate 4 Dogs, the adopter agrees to these Terms and Conditions.

1. Nature of Adoption and Transfer of Responsibility

Upon completion of the adoption, the adopter accepts full responsibility for the dog and becomes solely responsible for the dog’s care, supervision, control, conduct, veterinary treatment, and legal compliance, except where a separate written agreement expressly provides otherwise.

2. No Guarantees or Warranties

Donate 4 Dogs makes no guarantee, representation, or warranty, express or implied, regarding any adopted dog, including the dog’s present or future health, temperament, behavior, training level, compatibility with children, adults, other animals, or suitability for any particular household or purpose. The adopter understands that dogs are living animals and may behave unpredictably, and that future medical or behavioral issues may arise even if not known at the time of adoption.

3. Medical Information and Health Disclosure

Donate 4 Dogs will provide all known and reasonably available medical information in its possession at the time of adoption, which may include vaccination records, spay or neuter status, medications, prior treatment, and known medical conditions. However, Donate 4 Dogs does not represent or warrant that any dog is free from disease, infection, parasites, hereditary or congenital conditions, latent illness, orthopedic issues, neurological issues, or any other condition that may not be observable, testable, or diagnosable before adoption.

4. Behavioral Information and Risk of Future Conduct

Donate 4 Dogs will disclose any known and documented behavioral history in its possession at the time of adoption. Even so, Donate 4 Dogs does not guarantee that any dog will not bite, scratch, jump on people, injure a person or another animal, damage property, escape confinement, or display fear, anxiety, guarding, reactivity, or aggression. The adopter understands that behavior can change after adoption based on environment, stress, health, handling, training, and other factors outside the control of Donate 4 Dogs.

5. Adopter Assumption of Risk

From and after the date of adoption, the adopter voluntarily assumes all risks associated with owning, possessing, transporting, housing, handling, supervising, and caring for the dog. This includes the risk of illness, injury, biting, property damage, escape, nuisance, and all veterinary, training, and related expenses.

6. Release of Liability

To the fullest extent permitted by law, the adopter releases, waives, and discharges Donate 4 Dogs and its founders, officers, directors, employees, volunteers, fosters, agents, contractors, representatives, and affiliated veterinarians from any and all claims, liabilities, demands, damages, losses, costs, and expenses arising out of or relating to the dog’s health after adoption, the dog’s behavior after adoption, injuries or damage caused by the dog after adoption, veterinary or training expenses incurred after adoption, or any incompatibility between the dog and the adopter’s home or family.

7. Indemnification

The adopter agrees to defend, indemnify, and hold harmless Donate 4 Dogs and its founders, officers, directors, employees, volunteers, fosters, agents, contractors, representatives, and affiliated veterinarians from and against any and all claims, actions, damages, liabilities, judgments, settlements, penalties, costs, and attorneys’ fees arising out of or relating to the adopter’s ownership, possession, control, handling, transport, or care of the dog after adoption.

8. Veterinary Care and Humane Treatment

The adopter agrees to provide proper and humane care for the dog at all times, including adequate food, clean water, appropriate shelter, safe housing, exercise, supervision, routine and emergency veterinary care, and all vaccinations, licenses, and preventive care required by law or reasonably necessary for the dog’s welfare. The adopter accepts sole financial responsibility for all such care after adoption.

9. No Post-Adoption Refunds or Reimbursements

Unless otherwise required by law or expressly agreed in writing by Donate 4 Dogs, all adoption fees and related payments are non-refundable. Donate 4 Dogs is not responsible for reimbursing veterinary bills, training costs, behavioral consultations, property damage, or any other expense incurred after adoption.

10. Return, Surrender, and Rehoming Restrictions

If the adopter is no longer able or willing to keep the dog, the adopter agrees to notify Donate 4 Dogs promptly and follow its return or surrender procedures. The adopter may not abandon, sell, give away, transfer, or rehome the dog without prior written consent from Donate 4 Dogs, except where immediate action is reasonably necessary to protect the dog’s welfare or where otherwise required by law.

11. Compliance with Law

The adopter agrees to comply with all applicable federal, state, county, and local laws relating to dog ownership, including laws concerning licensing, vaccinations, leash requirements, dangerous dog regulations, confinement, nuisance, and control of animals.

12. Accuracy of Application Information

The adopter represents that all information submitted during the application and adoption process is true, complete, and accurate. Any false, misleading, or omitted information may result in denial of the adoption or other action permitted by law and any separately signed agreement.

13. Right to Refuse or Cancel Adoption Before Final Placement

Donate 4 Dogs reserves the right to deny any application or cancel any pending adoption before final placement for any lawful reason, including where Donate 4 Dogs determines, in its sole judgment, that the proposed placement is not in the best interest of the dog or the organization.

14. Website Use

Information on donate4dogs.org is provided for general informational purposes only and may be revised, updated, or removed at any time. Website access or submission of an application does not guarantee approval for adoption.

15. Entire Agreement

These Terms and Conditions, together with any separately signed adoption agreement, acknowledgment, medical record, behavioral disclosure, policy, or addendum provided by Donate 4 Dogs, constitute the entire understanding between Donate 4 Dogs and the adopter regarding the adoption.

16. Severability

If any provision of these Terms and Conditions is held invalid, unenforceable, or unlawful, the remaining provisions shall remain in full force and effect to the fullest extent permitted by law.

17. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of [Insert State], without regard to conflict of law principles.

18. Acknowledgment

By proceeding with an adoption through Donate 4 Dogs, the adopter acknowledges that the adopter has read and understood these Terms and Conditions, has had the opportunity to ask questions, and accepts full responsibility for the dog upon adoption.
